Terms of Service

Bookmark Brain is a product of Valitura, LLC ("Valitura," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Bookmark Brain's hosted service at bookmarkbrain.site, our Chrome extension, and related features (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Bookmark Brain lets you save, import, and organize bookmarks, and search them by meaning rather than exact title or folder. The Service fetches and stores the content of pages you bookmark, computes vector representations ("embeddings") of that content to power search and automatic clustering, and offers a browser extension for saving and searching from any tab. Some features (such as the weekly digest email) are optional and can be turned off from your account.
2. Accounts
You need an account to use the Service, created with an email and password or via "Sign in with Google." You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away at [email protected] if you believe your account has been compromised.
3. Free Trial, Subscriptions & Billing
New accounts get a 14-day free trial with full access to the Service — no card required to start. After the trial, continued access requires an active subscription. We currently offer monthly and annual plans; current pricing is always shown at bookmarkbrain.site/pricing. Subscriptions are billed through Stripe and renew automatically at the end of each billing period until canceled.
- You can cancel anytime from your account — access continues through the end of the period you already paid for.
- We don't offer refunds for partial billing periods.
- We may change our pricing going forward; we'll give existing subscribers reasonable notice before a price change takes effect on their subscription.
4. Acceptable Use
You agree not to:
- Use the Service for anything illegal, or to store or distribute content you don't have the right to save;
- Attempt to bypass rate limits, security controls, or access other users' accounts or data;
- Interfere with or disrupt the Service's infrastructure, or scrape/abuse the API outside normal use of your own account;
- Use the Service to build a competing product by extracting data at scale.
We may suspend or terminate accounts that violate these Terms.
5. Your Content
You own the bookmarks, URLs, and other content you save to the Service ("Your Content"). By using the Service, you give us a limited license to store, process, fetch, and analyze Your Content solely to provide and improve the Service for you — for example, fetching a page you bookmark so it can be searched, or sending its text to an embedding provider so it can be found by meaning. You're responsible for Your Content and for having the right to save it.
6. Third-Party Services
The Service relies on third-party providers to operate — including Stripe for payments, Google for optional sign-in, and one or more AI providers (such as OpenAI or Google) to compute embeddings for search. Your use of features backed by these providers is also subject to their own terms. We aren't responsible for the availability or behavior of third-party services outside our control.
7. Termination
You can stop using the Service and request deletion of your account and data at any time by emailing [email protected]. We may suspend or terminate your access if you violate these Terms, or discontinue the Service (or features of it) with reasonable notice.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that search results will always be accurate. To the fullest extent permitted by law, Valitura, LLC won't be liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new "Last updated" date. Continuing to use the Service after a change takes effect means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
